Under Ontario’s Collection and Debt Settlement Services Act and O. Reg. 460/17, the six-day statutory waiting period is the trigger that controls when a collection agency may begin collection activity — including reporting a debt to a consumer reporting agency.
Section 21(1) prohibits a collection agency from demanding payment, attempting to collect, or otherwise contacting a debtor until the sixth day after sending a compliant written notice.
Section 21(7) goes further:
No collection agency shall report a debt to a consumer reporting agency until the time period referenced in subsection (1) or (5) has elapsed, whichever is later.
That means reporting a collection account is legally tied to the six-day rule.
A collection agency cannot report a debt to:
Equifax Canada
TransUnion Canada
Until:
A fully compliant written notice was sent,
The notice met all mandatory content requirements,
The notice was properly served under section 26, and
Six full days have legally passed.
If any one of those steps is missing or defective, reporting may be premature.
It begins only after:
The notice is sent in a recognized manner.
If service cannot be proven where required, the waiting period may not legally begin.
If you notify the collection agency that you did not receive the written notice:
They must resend it, and
They must wait another six days after resending before taking collection action or reporting.
The waiting period resets upon resend.

It is the gatekeeper that determines whether a collection entry lawfully appears on your credit report.
If a collection account appears before the six-day statutory period has properly elapsed, that is a compliance issue — not merely a paperwork error.
Careful review of the notice date, service method, and reporting date can determine whether the reporting timeline complies with Ontario regulations.
